INTRODUCTION
www.anaprop.co.za respects the privacy of each User.
www.anaprop.co.za has
established this Privacy Policy to explain how Data is collected by
www.anaprop.co.za,
and how this Data is used and disclosed.
www.anaprop.co.za may process (collect, use or disclose) Personal Information only as described in this Privacy Policy.
In this agreement unless it appears to the contrary, the singular shall include the plural and
visa versa, any reference to any gender shall also includes the opposite gender and any
reference to a natural person, shall include legal person and visa versa.
COLLECTION
Collection on registration. Once a User registers with
www.anaprop.co.za, a User is
not anonymous to
www.anaprop.co.za. When registering, each User provides Data,
which includes an ID, a password, and an email address. To combat online fraud,
www.anaprop.co.za may also record the IP address of a User when adding Data. In addition, a
User may provide necessary Personal Information to process a credit card payment, including
a billing address.
Decline to share. A User can decline to share Personal Information with
www.anaprop.co.za by not registering with
www.anaprop.co.za.
Children. www.anaprop.co.za does not intentionally gather Personal Information about
visitors who are under the age of 13.
Collection from browser. www.anaprop.co.za automatically receives and records
information on
www.anaprop.co.za's server logs from the browser of a User, including
an IP address,
www.anaprop.co.za cookie information, and the page requested. Each
User should be aware that other web sites visited before entering the web site might place
Personal Information within a URL of a User during a visit to it, and
www.anaprop.co.za has no control over such web sites. Accordingly, a subsequent web site that collects
URL information may log some Personal Information.
USE
Messages and updates.
www.anaprop.co.za may send to a User administrative
messages and email updates regarding its account, the web site, or its Goods or Services. In
some cases,
www.anaprop.co.za may also send a User primarily promotional messages.
A User can choose to opt-out of promotional messages.
Cookies. Personal Information may be used to improve the web site.
www.anaprop.co.za may use cookies to save the IDs and session validators of a User on its browsers and
hard drives, and may use cookies to provide a tailored web site. IP addresses also help
www.anaprop.co.za to diagnose problems with and to administer the web site.
Targeted content. While a User is logged into the web site,
www.anaprop.co.za may
display targeted adverts and other relevant information based on the Data. In a completely
automated process, computers process the Data and match it to adverts or related information.
Natural persons do not read Data to target adverts or other information without consent.
www.anaprop.co.za never shares Personal Information with any advertiser, unless a
User specifically asks
www.anaprop.co.za to do so. Advertisers receive a record of the
total number of impressions and clicks for each advert. They do not receive any Personal
Information. If a User clicks on an advert,
www.anaprop.co.za may send a referring
URL to the advertiser's site identifying that a User is visiting from the web site.
www.anaprop.co.za does not send Personal Information to advertisers with the referring URL.
Once a User is on the advertiser's site however, the advertiser may collect Personal
Information.
DISCLOSURE
No selling. www.anaprop.co.za will not sell, share, or distribute Personal Information.
No Personal Information may be disclosed to anyone except as provided in this Privacy
Policy.
Marketing purposes. www.anaprop.co.za may disclose aggregate statistics (information
about the user population in general terms) about the Data to advertisers or business partners
for marketing purposes.
Third party supplier or agents. www.anaprop.co.za may need to provide Data to a third
party supplier to supply or provide specific Goods or Services to a User (such as hosting
services, support services, shipping services, or payment processing). Each third party
supplier is required to only disclose or use the Data to supply or provide the specific Goods
or Services requested.
Law enforcement. www.anaprop.co.za may disclose Data if required: by a subpoena or
other judicial or administrative order by law; to protect the safety of any individual or the
general public; to prevent violation of the Agreement, or the rights of
www.anaprop.co.za or any third party. An IP address may be disclosed to a third party: if the law or a
legal process requires it; to protect the rights or property of
www.anaprop.co.za, a User,
or the general public.
Affiliates. www.anaprop.co.za may share Data with an Affiliate, in which case
www.anaprop.co.za will seek to require the Affiliates to honour this Privacy Policy.
Change of ownership. If
www.anaprop.co.za undergoes a change in ownership, or a
merger with, acquisition by, or sale of assets to, another entity,
www.anaprop.co.za may
assign its rights to the Data it processes to a successor, purchaser, or separate entity.
www.anaprop.co.za will notify each User of the transfer and the User may choose to modify its
Personal Data at that time. If a User is concerned about its Data migrating to a new owner,
the User may deactivate or delete its account.
Employees. www.anaprop.co.za may need to disclose Data to its employees that require
the Data to do their jobs.
Abuse. www.anaprop.co.za may disclose Data to designated third parties to resolve or
investigate abuse complaints.
www.anaprop.co.za may release Data to assist in
attempting to block an abusive User or complain to its Internet Service Provider of an abusive
User.
SECURITY OF DATA
www.anaprop.co.za uses some of the most advanced security measures to protect the
Data under its control. All Data is safe, secure, and available only to the User and those to
whom User has granted permissions. In addition, the web site is hosted in a secure server
environment that uses a firewall and other advanced security measures to prevent interference
or access from outside intruders.
USERNAME AND PASSWORD
During the registration process,
www.anaprop.co.za will provide User with a username
and password. It is the responsibility of each User to maintain the confidentiality and security
of their password.
UPDATING OR REMOVING
A User may choose to correct or update the Data they have submitted to
www.anaprop.co.za, by going to their account. To remove any Data from the active database of
www.anaprop.co.za, a User may deactivate or delete their account. Even if a User updates or
removes their Data from
www.anaprop.co.za's live database, Data may be retained in
www.anaprop.co.za's backup files and archives.
UNAUTHORISED USE
Any unauthorised use of
www.anaprop.co.za information systems is a violation of the
Agreement and certain laws, including the section 86 of the ECT Act. Such violations may
subject the person to civil and criminal penalties.
INTERCEPT AND MONITOR
www.anaprop.co.za may intercept, monitor, block, filter, read, delete, and disclose any
communication over its information system.
LIMITATION
www.anaprop.co.za is not responsible for, gives no warranties, nor makes any
representations in respect of the privacy policies or practices of linked or any third party web
sites.
INTERNATIONAL USERS
www.anaprop.co.za may transmit or transfer Personal Information outside the resident
jurisdiction of the User and therefore across borders. Personal Information may be stored on
servers located in Germany where laws protecting Personal Information may not be as
stringent as the laws in the jurisdiction of the User. Personal Information may be processed
by
www.anaprop.co.za in the country where it was collected as well as other countries
(including Germany) where laws regarding processing of Personal Information may be less
stringent.

The request Procedure
Form of Request
The requester must use the prescribed form to make the request for access to a record. This must be made to the head of the private body. This request must be made to the address, fax number or electronic mail address of the body concerned [s 53(1)]
The requester must provide sufficient detail on the request form to enable the head of the body to identify the record and the requester. The requester should also indicate which form of access is required and specify a postal address or fax number in the Republic. The requester should also indicate if, in addition to a written reply, if any other manner is to be used to inform the requester and state the necessary particulars to be so informed [s 53(2)(a) and (b) and (c) and (e)]
The requester must identify the right that is sought to be exercised OR protected and provide an explanation of why the requested record is required for the exercise or protection of that right [s 53(2)(d)]
If a request is made on behalf of another person, the requester must submit proof of the capacity in which the requester is making the request to the satisfaction of the head of the private body [s 53(2)(f)]
If the request for access is refused the requester may lodge an application with a court against the refusal of the request within 14 days after the request for access to the record had been refused. For specifics regarding the complaint procedure please consult the Human Rights Commission at the aforementioned contact details [s 56(3)(c)]
Fees
A requester who seeks access to a record containing personal information about that requester is not required to pay the request fee. Furthermore, A requester who holds a beneficial interest in any securities issued by
ANAPROP PROPERTY MANAGEMENT has the right to inspect and copy without any charge the information contained in the record. Every other requester, must pay the request fee of R 50.00
at the management agent of the company.
After the head of the body has made a decision on the request, the requester will be notified in the required form.
If the request is granted then a further access fee must be paid for the reproduction and for the search and preparation and for any time that has exceeded the prescribed hours to search and prepare the record for disclosure [s 54(6)]
PART VI
The Minister of Justice and Constitutional Development has not yet made any regulations regarding any changes in fees.
PART VII
This manual is available for inspection by the general public upon request, during office hours and free of charge, at the management agent of the company.
